TaiChi4U – Terms & Conditions of Sale and Service

1. Introduction

Please read these Terms and Conditions carefully. By placing an order for Services or Goods, you agree to be bound by these Terms.

3. Definitions

3.1. Consumer – an individual acting for purposes outside their business or profession.
3.2. Contract – the legally binding agreement between you and us.
3.3. Delivery Location – the place Goods or Services are provided.
3.4. Goods – any items supplied by us.
3.5. Order – the Customer’s request for Services or Goods.
3.6. Services – the training, teaching, or related services provided by us.

4. Services

4.1. Service descriptions on our website or promotional materials are illustrative. Minor variations may occur.
4.2. For customised items, you must ensure all provided information is accurate.
4.3. All Services and Goods are subject to availability.
4.4. We may modify Services to comply with legal or safety requirements.

5. Customer Responsibilities

5.1. You must provide accurate information, cooperate with us, and grant access when required.
5.2. Failure to comply may result in suspension or termination of Services.

6. Basis of Sale

6.1. Promotional descriptions do not constitute a contractual offer.
6.2. We may refuse an Order for reasonable cause.
6.3. A Contract begins when we confirm acceptance in writing or start providing Services.
6.4. Quotes are valid for 7 days unless withdrawn earlier.
6.5. Variations to the Contract must be agreed in writing.

7. Fees and Payment

7.1. Pricing is displayed on our website or otherwise agreed in writing.
7.2. Prices include VAT where applicable.
7.3. Payment must be made within 3 days of invoice, unless stated otherwise.
7.4. We may require payment before Services or Goods are supplied.

8. Delivery of Goods & Services

8.1. Delivery occurs within agreed timeframes, or otherwise:
a) Services – within a reasonable time
b) Goods – within 30 days

9. Risk and Title

9.1. Risk transfers on delivery.
9.2. Ownership transfers once full payment is received.

10. Withdrawal and Cancellation

10.1. You may withdraw an Order before acceptance.
10.2. You may cancel within 3 days unless the Goods are custom-made (including Print-on-Demand items).
10.3. For eligible cancellations, Goods must be returned in unused condition at your expense.

11. RETURNS & REFUND POLICY – PRINT-ON-DEMAND (POD) ITEMS

11.1. All Print-on-Demand items (e.g., clothing, custom print products) are made individually for each order. For this reason, we cannot accept returns, exchanges, or refunds for:

incorrect size

colour choice

design choice

personal preferences

11.2. No refunds or exchanges are granted unless the item is faulty.

11.3. Faults must be reported within 14 days of receiving the item, along with evidence (e.g., photographs).

11.4. A replacement or refund will be issued only after the fault is verified.

11.5. Customers must check the size chart carefully before ordering, as size-related returns are not accepted.

12. SUBSCRIPTIONS, CLASS PACKAGES & MISSED CLASSES (NO REFUND POLICY)

12.1. All subscription plans, monthly memberships, block payments, and class packages are non-refundable once purchased.

12.2. Non-attendance does not entitle you to any refund, credit, extension, or rescheduling.
Missed classes are considered “used” regardless of attendance.

12.3. Unused classes are not carried forward to future weeks or months unless explicitly stated by the Supplier.

12.4. The only exception is if a class is cancelled by the Supplier. In this case, we will:
a) provide an alternative class, or
b) issue an appropriate credit.

12.5. Subscription plans renew automatically unless cancelled.
Fees already charged are not refundable.

12.6. It is your responsibility to cancel a subscription before the next billing cycle.

13. Conformity of Goods and Services

13.1. Goods must be of satisfactory quality, fit for purpose, and match their description.
13.2. Services will be provided with reasonable care and skill.

14. Duration, Termination & Suspension

14.1. The Contract lasts as long as required to perform Services.
14.2. Either party may terminate for serious breach or insolvency.

15. Privacy

15.1–15.7. (Privacy wording corrected and preserved, confirming GDPR compliance.)

16. Transfer & Subcontracting

16.1. Either party may transfer benefits of the Contract.
16.2. We remain liable for subcontractors.

17. Force Majeure

17.1. Obligations may be suspended in circumstances beyond reasonable control.
17.2. Customer rights regarding refunds and delivery remain unaffected.

18. Liability

18.1. We do not exclude liability for fraud, death, or personal injury caused by negligence.
18.2. We are not liable for unforeseeable losses or business losses.

19. Governing Law & Jurisdiction

19.1. This Contract is governed by the law of England and Wales.
19.2. Disputes may be raised in the courts appropriate to your location.

20. Complaints

20.1. Customers should contact us with concerns.
20.2. We aim to respond within 5 days with a proposed solution.

21. International Orders & Customs Fees

21.1. Customers outside the UK are responsible for all customs charges, import taxes, and duties.

22. Size Chart Responsibility

22.1. Customers must check all size charts carefully before ordering.
22.2. Print-on-Demand items cannot be returned for incorrect sizing.
